Supplemental Privacy Policy for California Residents


This California Residents Privacy Policy ("Policy") supplements the Spendgo Privacy Policy and applies to California residents. All terms in this Policy have the same meaning as in the Spendgo Privacy Policy.

If you are a California resident, you can request a notice disclosing the categories of personal information we have shared with third parties for the third parties’ direct marketing purposes. To request a notice, please submit this form.

INFORMATION WE COLLECT ABOUT YOU

As you use our websites and mobile applications or one of our Merchant Partner’s websites and mobile applications or visit a Merchant Partner’s stores, we may collect information about you and the services you use. Some examples of when we may collect this information include when you create a Spendgo account; use a Merchant Partner’s website or mobile application to purchase; or participate in a survey or promotion. The information we may have collected falls into six different categories:

Category A: Identifiers – We may collect information such as your email address or phone number.

Category B: Personal information categories as described in Cal. Civ. Code § 1798.80(e)) – We may collect information such as name, address, or financial information. Category D: Commercial information – We may collect information about your previous purchases or consuming tendencies.

Category F: Internet or other similar network activity – We may collect information about your browsing history, search history, interaction with our website, application, or advertisements.

Category G: Geolocation data – We may collect information about your physical location or movements. We may collect information about the location of your device, including GPS location, for purposes of enhancing or facilitating our services, such as enabling the functionality of our websites or mobile applications that provide you with information about our Merchant Partner’s stores near you, enabling you to remotely order and pay for our products and services, or have certain Merchant Partner’s products delivered by a third-party vendor. We may also use information about the location of the device you are using to help us understand how our websites, mobile applications, or those of our Merchant Partner’s and other services and functionality are being used and to deliver more relevant advertising. If you want to opt out of the collection of this location information, please see the section titled "Your Choices."

Category K: Inferences drawn from other personal information – We may collect information about your preferences.

HOW WE COLLECT INFORMATION ABOUT YOU

The information in the categories listed above might be collected as you use our websites and mobile applications or one of our Merchant Partner’s websites and mobile applications or visit a Merchant Partner’s stores. The information we may collect falls into three different categories: (1) information you give us; (2) information we collect from you automatically; and (3) information we collect from other sources.

HOW WE USE THE INFORMATION WE COLLECT ABOUT YOU

We may use the information we collect about, including personal information, as follows:

  • To provide our Services to you and to Merchant Partners, to communicate with you about your use of our Services, to respond to your inquiries, and for additional customer service purposes.

  • To provide you relevant deals and promotions specifically catered to you.

  • To display personalized ads to you.

  • To tailor the content and information that we may send or display to you; to offer personalized help and instructions; and to otherwise personalize your experiences while using our Services.

  • To provide you with news and newsletters, special offers, and promotions; to contact you about products or information we think may interest you; and for other marketing and promotional purposes.

  • To confirm your email address or contact information during the registration process, to prevent and detect fraud and related purposes.

  • To continually improve and better understand how our users access and use our Site, App, and services, both on an aggregated and individualized basis.

  • For other research and analytical purposes.

HOW WE SHARE THE INFORMATION WE COLLECT ABOUT YOU

We may share your information, including personal information, as follows:

  • Merchant Partners. Any of the information you provide us may be shared with a Spendgo Merchant Partner when you use the Services at one of their participating locations, if you have signed up for their rewards program, or opted-in to share your information with the Merchant Partner. Merchant Partners are responsible for the communications they send to you, and you should contact them directly to opt-out of receiving marketing messages (email or text messaging).

  • Other Business and Marketing Partners. We may disclose information we collect about you to unaffiliated third parties, who may use the information to market or advertise to you.

  • Service Providers. We may disclose information we collect about you to vendors, service providers, contractors, agents or other entities that perform functions on our behalf.

  • When you Give Consent. We may share information about you with other companies if you give us permission or direct us to share the information.

  • Business Transfers. We hope this is never the case, but we may transfer information we collect about you to another entity if we are acquired by or merged with another company, if substantially all of our assets are transferred to another company or as part of a bankruptcy proceeding.

  • In Response to Legal Process. We may disclose information we collect about you in order to comply with the law, a judicial proceeding, court order or other legal process, such as in response to a court order or a subpoena.

  • To Protect Us and Others. We also may disclose information we collect about you where we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Service or this Policy, or as evidence in litigation in which we are involved.

  • Aggregate and De-Identified Information. We may disclose aggregate or de-identified information that we collect about you through your use of our Services for advertising, research, and analytical services.

We may have disclosed these categories of personal information for a business purpose:

  • Identifiers

  • Personal information categories listed in the CCPA

  • Commercial information

  • Internet or similar network activity

  • Geolocation data

  • Inferences drawn

In the preceding twelve months we have not sold personal information.

YOUR RIGHTS

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, if applicable, we will disclose to you:

  • The categories of personal information we collected about you

  • The categories of sources for the personal information we collected about you

  • Our business or commercial purpose for collecting or selling that personal information

  • The categories of third parties with whom we share that personal information

  • The specific pieces of personal information we collected about you (also called a data portability request)

  • If we sold or disclosed your personal information for a business purpose: the personal information categories that each category of recipient purchased; or the personal information categories that each category of recipient obtained

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.

Opting Out

You have the right at any time to direct us not to sell your personal information, which is your right to opt-out. In the preceding twelve months we have not sold personal information.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights.
